1. About Selecta

Selecta ("we", "our", "us") operates a curated rental marketplace platform at stayselecta.com (the "Platform") that connects travelers with premium short-term rental properties across Argentina. By accessing or using the Platform, you agree to be bound by these Terms of Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Platform. By creating an account, you represent that the information you provide is accurate and complete.

3. Bookings

When you make a booking through Selecta, you enter into a rental agreement directly with the property host. Selecta facilitates the transaction but is not a party to the rental agreement. All bookings are subject to:

  • Availability confirmation from the host or system
  • Successful payment processing
  • Compliance with the property's house rules
  • The applicable cancellation policy (Flexible, Moderate, or Strict)

4. Payments

Prices are listed in USD unless otherwise stated. A 12% service fee is added to the nightly rate at checkout. Cleaning fees, if applicable, are displayed separately. Payments are processed securely through Stripe (credit/debit cards) or MercadoPago (Argentine payment methods).

Full payment is collected at the time of booking. Refunds for cancellations are processed according to the property's cancellation policy and returned to the original payment method within 5-10 business days.

5. Cancellation Policies

Each property lists one of three cancellation policies:

  • Flexible: Free cancellation up to 24 hours before check-in. Full refund minus service fee.
  • Moderate: Free cancellation up to 5 days before check-in. 50% refund for later cancellations.
  • Strict: 50% refund up to 7 days before check-in. No refund for later cancellations.

6. Guest Responsibilities

As a guest, you agree to:

  • Treat the property with respect and leave it in a reasonable condition
  • Follow all house rules set by the host
  • Not exceed the maximum number of guests stated in the booking
  • Report any damages or issues promptly
  • Not use the property for unlawful purposes

7. Host Responsibilities

Hosts who list properties on Selecta agree to provide accurate descriptions, maintain the property in the condition advertised, honor confirmed bookings, and comply with all local laws and regulations regarding short-term rentals.

8. Our Curation Process

Selecta reserves the right to accept, decline, or remove any property from the Platform at our sole discretion. Our AI-powered curation process evaluates properties on location, design, amenities, value, and guest reviews. Listing on Selecta is by invitation or application only.

9. Intellectual Property

All content on the Platform, including text, images, logos, and design, is owned by Selecta or licensed to us. You may not reproduce, distribute, or create derivative works without our written consent. User-submitted content (reviews, messages) remains your property, but you grant Selecta a worldwide license to use it on the Platform.

10. Limitation of Liability

Selecta acts as an intermediary platform. We are not responsible for the condition of properties, actions of hosts or guests, or any disputes between parties. Our liability is limited to the service fees collected. We do not guarantee the accuracy of property descriptions, photos, or ratings sourced from third-party platforms.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of the Autonomous City of Buenos Aires, Argentina.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify registered users of material changes via email.
